A surprise decision in AARP v. EEOC upended the rules for employee wellness, starting in 2019.  If your program requires “medical exams” (such as biometric screenings) or “medical inquiries” (meaning most health risk assessments), you may no longer dangle large incentives or threaten large penalties. Only “voluntary” programs with those components, and activity-based programs, will continue to enjoy a safe harbor from employee challenges and litigation.
